Terms and Conditions

Version 10.16.26b · Effective October 16, 2026

1. About these Terms

These Terms and Conditions (“Terms”) are an agreement between you and Fuego Racing LLC, an Oklahoma limited liability company (“Fuego,” “we,” “us”). They cover racefuego.com and its online nomination form (together, the “site”). By using the site or submitting the form, you agree to these Terms. Our Privacy Policy explains what we collect and who receives it.

2. The Rules govern the program

The Fuego Incentive Program is governed by its Rules. These Terms do not change any fee, deadline, eligibility rule, flight, or award in the Rules. Where these Terms differ from the Rules, or for a slot holder from the Stallion Slot and Nomination Agreement, the Rules and the Agreement control. The Nominations page summarizes the Rules, and the Fuego office (office@racefuego.com) will email you the full Rules on request. Quotations below are from the Rules, version 10.16.26.

3. Nominating a horse

To submit the form, you must be 18 or older and of legal age to make a contract where you live, and own each horse you nominate or be authorized by its owner to nominate it.

Give accurate and complete information. We compute each horse’s Division Year from the pregnancy or transfer date you enter.

Before you submit, you confirm the statements the form shows, such as that you accept the Rules and that your information is true and complete. We record your acceptance, as our Privacy Policy describes. The office may ask for proof of ownership or authority.

The eligibility, flight, and amount your confirmation shows for each horse are calculations from what you enter.

Submitting the form charges nothing. The office emails you an invoice from QuickBooks (Intuit). You pay by card or ACH on Intuit’s payment page, or by check by mail; the form asks only which you prefer, never for card or bank account numbers. Payment methods and fees are as the Rules and the Nominations page state.

The Rules say: “Nomination payments are non-transferrable (meaning you cannot transfer payment to another horse) and are non-refundable.” If you think an invoice is wrong or you paid twice, write the office.

The Rules also say: “a deadline is not met unless the full amount including any processing fee is paid. A payment by check is timely if it is postmarked on or before the deadline. A payment by ACH, credit card, or cash is timely when it is received.”

4. Your Fuego account

Submitting the form does not create an account or a login. We will later create an account from what you submit and email you a link to set a password. The horses you submitted will be in that account.

Once you have a login, keep your password private; you are responsible for what happens under it.

5. Documents you upload

Uploads are optional. You may add documents such as registration papers, bills of sale, transfers, leases, or owner authorizations. Papers are not needed to nominate; if you get them later, email a copy to the office, as the Rules require.

When you upload a document, you confirm you have the right to share it with us, including the details of other people shown on it.

You keep ownership of your documents. You give us a non-exclusive, royalty-free right to store, copy, convert, review, and use them, and to share them as our Privacy Policy describes, to run the program and keep its records.

We convert files when we store them, so keep your originals.

Never upload or email W-9s or other tax forms, Social Security or tax ID numbers, bank or card details, or check images.

6. Email notices

We email you about your nominations: the confirmation of your submission, your invoice, requests for papers, and later the link to set your password. These are about your nominations, not marketing. Submitting the form does not sign you up for marketing email. To change your email address, write the office.

7. Acceptable use

Do not:

We may block anyone who breaks these Terms.

8. Fuego’s content and marks

The site’s text, design, logos, and graphics belong to us or our licensors. Fuego, the Fuego logo, The Fifty, and the flight names Inferno, Caliente, Azul, and Ember are marks Fuego uses; do not use them without written permission, except to say truthfully that a horse or stallion is in the Fuego program, or which flight it is in. Other names on the site, such as AQHA, APHA, Remington Park, and the stallions’ registered names, belong to their owners.

9. Information from others

Stallion pages show details that come from each stallion’s slot holder (the Rules say stallion nominator) and our records, such as stud fees, flights, photos, and contact details. The Rules say: “Stallion nominators represent their advertised stud fee to Fuego and it is published on the Fuego website.” We do not promise that information others provide is accurate or current. Confirm anything that matters to you with the stallion’s owner or standing ranch.

10. No guarantees

The site is provided “as is” and “as available.” To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not promise that any horse will qualify, start, or earn money. The Rules say: “Nothing in these Rules guarantees that any race other than the Fuego Futurity will be held, or guarantees a particular format or division structure for it.”

The site may be unavailable at times. If the form is down or your invoice has not arrived near a deadline, write office@racefuego.com before the deadline passes.

Nothing on the site is legal, tax, or investment advice.

11. Limits on liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost breeding or racing opportunities, or lost data, arising from the site. Our total liability for any claim about the site is limited to the greater of $100 or the amount you paid us for nominations in the 12 months before the claim.

These limits do not apply to fraud, willful injury, gross negligence, willful misconduct, violation of law, or personal injury, or where the law does not allow them.

12. Oklahoma law and courts

Oklahoma law governs these Terms, without regard to its conflict of law rules. The courts in the State of Oklahoma have exclusive jurisdiction over any dispute about these Terms or the site. Nothing in these Terms takes away a consumer protection right that the law where you live does not let you waive. If a court finds part of these Terms unenforceable, the rest stays in effect.

13. Changes to these Terms

We may change these Terms. Each version carries a version label and an effective date, and we post it on this page. A change does not apply to a dispute that arose before it took effect. The Rules change only as the Rules themselves provide.
