1. Who we are
Fuego Racing LLC (“Fuego,” “we,” “us”), an Oklahoma limited liability company, runs the Fuego Incentive Program and racefuego.com. This policy covers the website and the nomination form. The Fuego Incentive Program Rules (the “Rules”) govern the program itself. You can reach the Fuego office at office@racefuego.com.
2. What we collect
When you visit
- Request logs. Kinsta, our web host, and the Cloudflare network in front of it log your IP address, browser, the page, and the time.
- Files from other servers. Some pages, including The Fifty and the stallion pages, load fonts from Google Fonts and scripts from cdnjs (Cloudflare), which receive your IP address and browser details.
- No analytics, advertising, or social media tracking. Our Facebook and Instagram links are plain links.
When you nominate a horse
Nominating does not create an account or a login. The form asks for:
- About you: your email address, typed twice so we know it’s right; your legal name; an optional ranch or business name; your phone number; your mailing address in the United States, Canada, or Mexico; and a billing address, if it is different.
- About each horse: its name (optional), whether it is registered, the registry (AQHA or APHA), the registration number, sex, year foaled, the sire (one of The Fifty), the dam, the breeder of record, whether the mare carried her own foal or it came from an embryo transfer (fresh or frozen), and the date the mare became pregnant or of the transfer.
- Ownership: whether someone other than you is the registered owner on the papers, and your statement that you own the horse or are authorized by its owner.
- Payment: the method you prefer (card, ACH, or check).
When you submit, we record your acceptance: the statements shown to you, the versions of the Rules, these Terms, and this policy, the time, your IP address, and your browser. We also keep what your confirmation showed you for each horse (its eligibility, flight, amounts, and due dates) and the payment method you chose. The office receives a copy of your submission by email.
Documents you upload
You may upload documents for each horse, such as registration papers, bills of sale, transfers, leases, owner authorizations, or another document for the horse. We check each file, re-save photos (which removes hidden data such as location), and rebuild PDFs from images of their pages. We then encrypt the file and store it in private storage. When you send the form, the office’s email copy of your nomination also carries these files, up to 10 MB in all, and your confirmation email lists each file we received.
Never upload or email W-9s or other tax forms, Social Security or tax ID numbers, bank or card details, or check images.
2026 stallion applications
Our 2026 stallion application form, now closed, asked for details of the stallion, the standing ranch, the owner, and the stallion nominator, with a typed signature. The form tool also recorded each entry’s IP address, browser, device, and country.
Stallion pages
The stallion pages show each stallion’s owner and the standing ranch’s address, phone, email, website, and social media links, from the office’s records. To change or remove them, write to the office.
Email you send us
Email to office@racefuego.com, with any attachments, goes to the office’s Google Workspace mailbox and its Intercom shared inbox. Fin, an AI agent, may answer first.
3. How we use your information
We use personal information to:
- run nominations, entries, and the breeder and stallion nominator awards under the Rules, and confirm registration, parentage, ownership, and eligibility;
- invoice you, record your payments, and contact you about your horses;
- set up your Fuego account later;
- keep a record of what you accepted and when;
- protect the site from spam and abuse; and
- meet our legal, tax, and regulatory duties.
We do not sell personal information or share it for advertising.
4. Who receives your information
Service providers
- Kinsta hosts the site and everything it stores, including nomination records and backups.
- Cloudflare runs the network in front of the site and checks for bots (Turnstile, when turned on). Its cdnjs service serves scripts to some pages, and its R2 storage holds uploaded documents, encrypted.
- Google. Google Workspace sends the site’s email and holds the office’s mailbox, including the office’s emailed copy of each nomination with its files, and spreadsheets, including the roster behind The Fifty. Google Fonts serves fonts to some pages.
- Intuit (QuickBooks) handles invoices and payments. It receives your name and any ranch or business name, your email, phone number, and mailing address, and the horses and amounts on your invoice. You pay by card or ACH on Intuit’s page, under Intuit’s own privacy policy and terms, so we never see or store your full card or bank numbers. A check shows your bank account number; the office deposits it and records it in QuickBooks, and we keep no check images on this site.
- Intercom runs the office’s shared inbox and Fin. It receives email to the office, with attachments, including the office’s copy of each nomination, and any conversation with Fin.
Our providers may process information in the United States and other countries.
Racing and registry partners
To confirm registration and parentage, we may check a horse’s details with AQHA or APHA. When a horse races or earns an award, we share what is needed with those who run that part, such as the Oklahoma Horse Racing Commission and the host racetrack and its Horsemen’s Bookkeeper.
Legal requests and a sale of the business
- When the law requires it, or when needed to protect people, enforce the Rules, or defend a claim.
- If the business changes hands. If Fuego or the program is sold, merged, or reorganized, program records go with it and stay covered by this policy.
5. Cookies and similar technology
- Your nomination (Fuego): no cookie is set while you fill in the form. After you send it, a cookie holding a random code shows your confirmation for 30 minutes.
- Bot check (Cloudflare): may set a short-lived cookie to tell people from bots.
- Spam protection on the form: a hidden field only bots fill in and, when turned on, Cloudflare Turnstile, which checks your browser.
Apart from the providers named in this policy, we do not let other companies collect information about your activity on this site or across other websites. The site works the same whether or not your browser sends a Do Not Track or Global Privacy Control signal.
6. Emails we send you
The emails listed in our Terms and Conditions are about your nomination, not marketing. The site sends no marketing email. If we add program news, it will go only to people who ask for it, with an unsubscribe link and our mailing address in every message.
7. How long we keep your information
A horse’s eligibility depends on its nomination history. The Rules say: “A horse must be nominated every year, without a lapse, to be eligible for any future Fuego race.” (Rules, version 10.16.26, Proposed Program Roadmap.)
So we keep nomination and acceptance records, documents, invoices, and payment records for as long as the program operates, and after that for as long as law, tax rules, or a possible dispute requires. Also:
- Full copies of the site’s email: 90 days.
- Log of the site’s email (recipient, subject, and time, not the message): kept with the program’s records.
- 2026 stallion applications, the office’s emailed copies of nominations and their files, and email you send the office: kept with the program’s records.
- Request logs: on Kinsta’s and Cloudflare’s schedules.
- A nomination never sent: we keep none of your answers. Files you uploaded are deleted when you remove them, when you send the form without them, or within a day if you never send it.
- Backups: information deleted from the site can stay in backups. Encrypted backup copies of uploaded documents have no set end date.
8. Security
- Uploaded documents are encrypted on our server before they reach Cloudflare’s private storage, which holds only the encrypted files.
- Only the office and the site’s administrators can open uploaded documents. There are no public links to them, and each opening is recorded. The copies emailed to the office stay in its mailbox.
- Pages are served over encrypted connections.
Encryption protects the stored files. It does not protect against a break-in to our web server. If a breach affects your personal information, we will notify you as the law requires.
9. Your choices and requests
Write to office@racefuego.com to ask what we hold about you, or to correct or delete it. We confirm a request is yours before we act, usually by replying to the email we have on file. The site has no self-service download or delete; the office handles each request.
We correct records that are wrong and keep a history of the change. On a deletion request, we remove what we can and tell you what we kept and why. We must keep what the program and the law require: nominations, acceptance records, invoices and payments, ownership and eligibility records, and anything needed for awards, taxes, or a dispute. We will not treat you differently for making a request.
10. Children
The nomination form is for adults. The site is not directed to children, and we do not knowingly collect their information. If you believe a child has given us information, tell the office and we will remove what we can.
11. Changes
We post each new version here with its version label and effective date, and will post an updated policy before Fuego accounts open. Ask and we will send you an earlier version.
